Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ReadinessIQ.ai website, mobile experience, chat assistant ("RED"), Readiness Scorecard, borrower portal, and related services (collectively, the "Service"), operated by ReadinessIQ.ai ("ReadinessIQ", "we", "us", or "our"). By accessing or using the Service, you agree to these Terms and to our Privacy Policy and E-Sign & Communications Consent. If you do not agree, do not use the Service.

1. Not a Lender; Educational Only

ReadinessIQ is not a lender, mortgage broker, credit repair organization, tax advisor, attorney, financial advisor, or fiduciary. Nothing on the Service is a loan approval, denial, commitment, rate lock, or offer of credit. All output — including scores, verdicts, program eligibility estimates, payment simulations, and AI-generated analysis — is educational and preliminary only. Final qualification is subject to a licensed lender's review, valid AUS findings (DU/LPA/TOTAL/GUS), appraisal, credit verification, and program guidelines. Do not rely on the Service for legal, tax, or investment advice.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract in your jurisdiction. You agree to provide accurate, current, and complete information.

3. Accounts and Security

You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us at support@readinessiq.ai if you suspect unauthorized use.

4. Loan Officer Handoffs

If you opt in, we may share your readiness profile and contact information with a Licensed Mortgage Loan Officer ("LO") to continue the process outside the Service. Any resulting loan application, disclosure, quote, or transaction is governed by the LO's and their lender's own agreements and applicable law. ReadinessIQ is not a party to that relationship and receives no compensation contingent on any specific loan outcome.

5. AI Assistant ("RED")

RED is a generative-AI system that may occasionally produce inaccurate, incomplete, or outdated information. Guideline citations reflect the sources indexed at the time of response and are not a substitute for a licensed underwriter's decision. Verify all figures with your assigned LO before making financial decisions.

6. Acceptable Use

You agree not to:

• Submit false, misleading, or impersonated information.
• Reverse-engineer, scrape, or resell the Service or its output.
• Upload content that infringes another party's rights, contains malware, or violates law.
• Attempt to bypass rate limits, authentication, or security controls.
• Use the Service for automated bulk decisioning or resale as a lending tool.

7. User Content and License

You retain ownership of documents and information you upload. You grant ReadinessIQ a limited license to process that content solely to provide the Service, generate your readiness analysis, and (with your consent) share it with your assigned LO. We do not use uploaded financial documents to train AI models.

8. Fees

The consumer-facing Service is currently free. We may introduce paid features in the future; if we do, you will be notified before any charge and asked to consent.

9. Termination

You may close your account at any time from your portal. We may suspend or terminate access if you violate these Terms or applicable law, or to protect the security or integrity of the Service.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, READINESSIQ AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

12. Indemnification

You agree to indemnify and hold harmless ReadinessIQ from any claim arising out of your misuse of the Service, breach of these Terms, or violation of applicable law.

13. Arbitration and Class-Action Waiver

Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, and not in court, except that either party may bring a claim in small-claims court. You and ReadinessIQ each waive any right to a jury trial and to participate in a class action or class arbitration. You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@readinessiq.ai with the subject "Arbitration Opt-Out".

14. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles.

15. Changes

We may update these Terms from time to time. Material changes will be posted here with an updated "Last updated" date; continued use after posting constitutes acceptance.
